that's a good question, considering this happened in New Orleans, the one jurisdiction in the US where that principle does not apply. On the other hand, it seems they were charged under federal law, so this point may be moot. Any N.O. lawyers out there who could clarify?

Your employee, O'Keefe could have staged a break-in with actors and props if he wanted to merely prank a senator. And so I ask, why would he risk getting caught on Federal property to do the same unless he wasn't a common criminal to begin with? Whatever journalistic panache he had is undermined by his flouting of the law, and if he had any real balls he'd go cover the war on the front lines.
I'm reasonably sure that entering a federal office under false pretenses in this manner is a crime of some sort, worthy of a slap on the wrist and a suspended sentence, much like protesters get when they take over a government office and have to be carried out by the cops. If the cause is important, you should be willing to pay the price, and should wear the conviction as a badge of honor. In any event, its not a felony, Michael. Get a brain. Can't wait for the video.

When I first heard this gossip about the Senator's office and four young men, I waited, wondering who was doing what to whom. Almost a heartbeat later the arrested fellows had been released.
To me it was a story that ended before it began. But why was it told???
Unbelievably there was a good report on this on MSNBC ( I was flipping around and caught this) I believe it was Dylan Ratigan explaining that today's phones can't be tapped (or tampered with) in the way that O'Keefe was accused of. Handsets don't open and everything else is done with chips or is inaccessible. Also O'Keefe was taping the event suggesting it was just a stunt. Some blogs on the right have suggested that the event could bring up something to make Landrieu bad…let's hope that's right.

None of Landrieu's FOUR offices were available via telephone from at least Thanksgiving until after the 1st of the Year. I know. I tried. Countless other local constituents tried. Vitter's office (as I understand it from one of his staffer) was flooded with phones calls just to complain about Mary's hiding behind her telephone system. As it was put to me, her "customer service" is below par and the sentiment is very WIDESPREAD.
I cannot even begin to explain the frustration of Louisianians all over the state with the inaccessibility of Landrieu. Because of this, two dozen volunteers showed to to man a phone bank set up by Bill Cassidy (Congressman) on the first of two night to support Scott Brown. If Landrieu had of allowed her offices to take calls and not keep their doors locked, the number showing up would have been maybe 6.
