Today is the day that I have been invited to go on MSNBC for the very first time. At no point during the ACORN story was I put on the hot seat to defend the work of James O’Keefe. My thesis from day one has been that the mainstream media is biased in favor of the left and MSNBC is its most obvious case study.
So when MSNBC led the charge on Tuesday against James O’Keefe when he and three others were arrested in New Orleans at Senator Landrieu’s office, it came as no surprise that the cable network seized upon a narrative that presumed O’Keefe’s guilt, falsely extrapolated that he was being charged with felony wiretapping and instantaneously coined and repeated endlessly the new buzz phase, “Watergate Jr.”
Thus it came as no surprise to me that Keith Olbermann’s super sub, David Shuster, called me early Wednesday. ”Watergate Jr.” pushed MSNBC to send Shuster down to New Orleans to own the destruction-by-media of James O’Keefe and anyone in his proximity. I immediately told Shuster that I had been getting emails about his absurd, over-the-top and rush-to-judgment journalism. He told me that I had him confused with Rachel Maddow and Keith Olbermann, that he has “no horse in this race.” He asked that I come on his show and that he would give me a fair interview. He proceeded to send me the following emails to formalize the request. See below (emphasis mine):
As you see, Shuster is attempting to lure me into this story based upon the false premise of his objective neutrality. Notice he says, “As I said, I don’t have a horse in this race.” A simple Google search of David Shuster and James O’Keefe immediately finds that Shuster went into a Twitter frenzy to tar and feather James O’Keefe and propagated what are now provably false lies about the Landrieu case.

As I am signing off here, I have just been informed that MSNBC has admonished Shuster for “inappropriate” twitter comments. But what about Shuster’s obvious lie that he has no “horse in this race,” a lie he used to try to get me into the Obama-stimulus-infused, bias-laden MSNBC eco-system? Could there be a greater admission of a journalist’s political investment in a storyline than divining (”the truth is, you intended to tap her phones”) a subject guilty of a crime he has not even been accused of? Remember, Shuster has sold out Olbermann and Maddow as the ideologues in the newsroom. If Shuster is their idea of journalistic neutrality, I can continue to sleep well acting as a journalist who openly admits that he comes to the table with a unique political perspective.

I was watching Shuster on Chrissy's show last night and he seemed to have egg on his face admitting that it seems like there was nothing malicious or even illegal in what O'Keefe and others did. Matthews still insisted that they would be sent to prison anyway and cited a law saying that it is a felony to enter a federal building misrepresenting your identity with the intent to commit a felony. I thought that last line was rather interesting because Shuster had just told him that it appears they wern't doing anything illegal in the Senator's office. My presiction, O'Keefe knew the laws, expected this outcome, will get off scott free, and is just playing these guys for the fools we all know them to be.
I, too, have (repeatedly) offered to proof their work. So many simple never-to-be-fixed mistakes on the BIG sites (it's, its, their, there, etc) that even a picky homemaker thinks it makes us all look bad.
No matter how qualified and competent you are, you will not survive the beating you will receive at the hands of these fools. Your fatal flaw is that you are an honorable and honest man. It is difficult for decent humans to prepare themselves for interactions with sociopaths. Their brains do not function the same as those of mentally healthy people. No matter how irrational you think they will be, your prediction won't even be close. Good luck!

I usually do not comment on posts, but I had to respond. I cannot stand MSNBC and their anchors. I was changing channels and saw the Shuster interview and watched. It was too funny! He was trying to not let you state your point. You handled yourself well and he looked like an idiot. If O'keefe really did try to tamper with phones, he is an idiot and should be in jail. I did see his videos on Acorn and applaud them. About time someone stood up and let people know! But i do not feel he should go as far as to break the law with the phone thing. That is just wrong! I like the theory that Mr. O'keefe, who I consider a journalist, went to Landreau's office to figure out why she doesnt answer the phone. (I am sure her constituents are POed and would like her to know), which is not against the law. Why else would he be taping the incident. Of course the MSM is going to portray this as some sort of Watergate (which I feel was blown way out of proportion, not that I support what went down that night), and try to smear him. 1)Why would someone "enjoy" the prosecution of a 25 year old kid, whose only known action previously was to expose wrongdoing at ACORN?
2) Have to brush up current libel law, is this kid a public figure? If so, the "journalist" sent to cover the incident…did his comments on Twitter amount to malice aforethought? There is nothing I see that indicates any protection of the "alleged" criminal acts.
3) In fact, it appears that through innuendo, he is trying to tie Andrew to those acts.
4) As an act in furtherance, he tells Andrew that he's not like Olbermann or Maddow…and he "doesn't have a horse in this race". Is he setting up an entrapment, so that he can intentionally further damage either the 25 yr old kid…or Andrew…or both?

I can't imagine a reporter on Fox News sending such inflammatory and biased tweets. This was revelatory of the true nature of the radical left and their propaganda press at MSNBC. It wouldn't surprise me if O'Keefe was there to prove Landrieu's office was avoiding calls from we, her constituents. The minute Landrieu announced she was going to vote for the Health Care Bill, I submitted an email to her office. My letter was professional and had no malice whatsoever except to announce my displeasure with her choice. I have yet to receive as much as a "scripted" letter in reply. I have also placed calls to her office and found that the phones either rang till disconnecting or received "mailbox is full" recordings. I have also spoken (over this period of time) to many other Louisianans that have attempted the same with no results. Could this be a pattern? Maybe – maybe not(?)
However, MSNBC showed their colors with this interview. And I like how Shuster ended the interview "we appreciate your joining us and "trying" to make your case. Andrew attempts to try and make the case was only because Shuster held the interview in typical MSNBC 3-Stooges style. Amazing how the liberals find fault in conservatives talking over others but can't look in the mirror at themselves for the same sin they claim to despise. Desperation is such an ugly trait to witness.

Cincy – I have read the FBI affidavit. I am a former judicial clerk, have written hundreds of jury charges, and have been practicing law for 17 years. The sworn statement you reference does not provide evidence of each element of the crimes set forth, as those crimes are defined by the cited sections of the U.S. Code. Go back, read the code, determine the elements of the crime, and see if you can find evidence of each element. THEN come back and post.

You see, I spent some 30 years on your side, not only learning these tactics, but perfecting them to ninja-unicorn like stature.
First you will have a polite introduction, a couple of chummy exchanges, then you will pretend to frame the debate with your first questions. Your questions will inevitably be sprinkled with false allegations, outrageous charges, and all other sorts of straw man fallacies.
Your opponent will begin to answer your questions, as long as they appear to mumbling or stumbling, with a pleasant smirk on your face. If the response starts to sound coherent, you will interrupt them in mid sentence purely to prevent them from finishing. If your opponent starts making real sense, you'll panic, start getting nasty and loud, and if necessary you will shout them down entirely.
Because, after all, your main goal here isn't to report or inform. It's certainly not to hold any type of real, honest debate, least of all on any relevant issues. No, your real goal is to create a great act of theater of politics. Where your audience roots for you the good guy, as you slay the bad guy. Then all their positions will be validated, and life will go on.
If I were you though, I might spend some times reviewing your ratings, because I think those who love your version of theatrical politics are rapidly dwindling.

Andy, you've got a much bigger problem than David Shuster.
James O'Keefe III, one of your employees (your word, to Hugh Hewitt), was arrested with three other youngsters on charges of entering a federal building under false pretences with intent to commit a felony, the felony they intended to commit being tampering with the phone system in a sitting U.S. Senator's office. All indications are that your employee, and others, have confessed to the conduct giving rise to the charge. The entry is a felony, punishable by as much as 10 years in federal prison.
The lawyer for one of the youngsters is trying to call it a harmless stunt that lacked intent to commit the felony, but the circumstances strongly suggest otherwise. Mr. O'Keefe publicly alluded to the operation in a speech to a right-wing organization in December, and the elaborate level of planning indicates more than a prank. Moreover, while in the senator's office, they requested entry to the room containing the phone system, something that wouldn't have been necessary if this was all some sort of joke.
It is reasonbly clear to anyone who has read the coverage that one or all of the defendants is talking. And why not? These young men — boys, really — are looking at possible hard time and ruined lives. They have every good reason to sing the sweetest songs this side of the Vienna Boys Choir.
Now here is where it gets interesting, Andy. You claim that you never discussed the caper with your employee, even though you published the video results of another "stunt" the same employee conducted last year. With your employee facing a federal steamroller — something his father, a U.S. attorney, can explain to him now that the boy has been emasculated by a federal court order to move back to his Mom and Dad's house — he will have every incentive to answer the FBI's questions about the genesis and the planning of the operation.
Andy, if you even spoke tangentially to your employee about the idea of invading Sen. Landrieu's office, you could easily be looking at a federal conspiracy charge. You can kick and scream and stamp your little feet to your heart's content, but if you were anywhere near the genesis of this caper, then all the king's blogsites and all the king's men, won't be able to put poor Andy Breitbart back together again.
Get a good lawyer, Mr. Breitbart, because I think you'll be needing one. This is the federal government you're dealing with, and we're talking about a crime committed in a federal office building against a sitting United States senator. Agree. Could it be that O'Keefe and company came up with something that would get them arrested because they knew the media would jump on it like locusts? (Bear in mind that his claim to fame is pulling off several successful stings.) I told my husband yesterday that I think it could have been a tactic to force the MSM to explain who O'Keefe is in the context of this incident, introduce the back story of the ACORN videos to the vast public that hasn't seen or heard them, and thereby compel the media to expose their own bias and justify why they didn't cover the story.
This is all just speculative because I don't subscribe to conspiracy theories, but it just doesn't square to me that the guy who was shrewd enough to covertly record all those ACORN episodes without getting caught would be stupid enough to allow the office workers see him filming with his cell phone. Why didn't he use the glasses-cam that he employed for the ACORN videos? Guess we'll have to wait and see.

Wow. On th one hand Shuster is hardly an impartial "journalist" trying to get the truth – he was trying to tie Andrew to this alleged "crime" (and hence discredit him over the ACORN investigation). OTOH that shouting over each other – which O'Rielly and Hannidy also do, drives me nuts.

After reading through a couple of the nine (!) pages of comments mostly defending O'Keefe I am really left scratching my head.
Yes, it is true that the affadavit does not allege wiretapping activities. On the other hand, it doesn't seem especially outrageous to me that in the first 24 hours of the news cycle, when the sole facts in evidence were their arrests for trying to access (under false pretenses) the Federal Building's telephone infrastructure that a sensible person might initially assume at minimum the intent to tamper with the equipment, or perhaps wiretapping.
It is clear that from the affadavit that two of the individuals involved (not O'Keefe) were falsely impersonating phone company employees. It is also clear that after spending a few minutes in the Senator's office they requested the location of the telco closet and subsequently attempted to gain entrance to it. And it was at this point that they were caught (when unable to provide credentials to the GSA employee who requested them).
My question then is quite simple:
To those who are defending the four young men & castigating the MSM for sloppy initial reporting, what exactly you think they were trying to do when attempting to gain entry to the building's telco closet? I cannot see any reading of this that would imply good motives, but I am willing to listen to anyone willing to explain how their behavior is somehow exemplary of anything but reckless stupidity. What is it exactly do you think they were going to do if access to the phone infrastructure had successful? Dust off the panel boards?

Just a thought here but if it were me that was being interviewed I think the moment that the interviewers false intentions were revealed you have the right to take the conversation in whatever direction you want and completely ignore anything the interviewer says.
