The family of Greg Baer, Bank of America executive, is located in a jurisdiction protected by the Montgomery County Police Department (MCPD), which responded promptly to a disturbance call from his neighborhood last weekend.
According to Corporal Dan Friz, an MCPD spokesperson in Rockville, Maryland, the department received a disturbance call from one of Baer’s neighbors at 4:10 pm last Sunday. Four MCPD units arrived at Baer’s Greenville Rd. address at 4:15 pm. At least two Metropolitan Police Department units from the nearby District of Columbia were already at the scene when they arrived.
Why? Because police cars attached to the Washington MPD’s Civil Disturbance Unit had escorted the SEIU protesters’ buses to Baer’s home. Such cross-jurisdictional escort activity is not uncommon for both departments according to Friz and Metro Police Department spokesperson Officer Eric Frost. Still, the District police did not inform their colleagues of what was about to happen in one of their Maryland neighborhoods.
The Maryland officers reported there were approximately 500 protesters on and near the front lawn of Baer’s house. Montgomery County was not given a “heads-up” concerning the planned protest. Although a protest permit is technically required in Montgomery County, in practice no citation is issued if the protestors disperse when requested to do so by the owner of the private property they occupy.
The primary role of the Washington cops in this event was to protect the protesters. The D.C. officers had no authority to act to disperse the protesters even had the homeowner been present and asked them to vacate the private property. The event ended as a “dash one”– no arrests, no citations – according to Friz. The Montgomery County units left the scene at 5:29 pm.

According to Friz, “members of protest groups know how far to push the envelope” and wait for “the key words” – for example, the property owner’s request that they leave – in order to avoid arrests or citations. For example, protesters are required to keep on the move, since a standing protest violates a Montgomery County code. And, while photographs clearly suggest that many of the SEIU protesters were stationary, the District police don’t have any authority to enforce Montgomery County laws.
So, let’s sum this up: A caravan of SEIU buses receive a Metropolitan (D.C.) Police Department escort to a private home in Maryland where the protesters, from all appearances, violate Montgomery County law by engaging in a stationary protest. The Montgomery County police were not informed by their cross-jurisdictional colleagues of the impending, unusually large protest pending in their jurisdiction.
What’s up with that? Had the mob decided to torch the house, the D.C. police would not have been authorized to intervene. Not their jurisdiction. They’re just escorts. Meanwhile, a teenage boy is home alone, frightened by what’s happening outside his front door.

I can't believe the entire nation is not in an uproar about this. Politics and business are one thing (Ok, most often two things), but a large protest at a residence is completely out of line. I like to make one point, under the Patriot Act, any deputized law enforcement officer in the U.S. is a police officer no matter what state or jurisdiction they are in, within the United States, as such, DCMP is liable for all actions and damages done, they are also subject to prosecution for violations for not enforcing state and local laws or properly notifying the local jurisdiction in Maryland of their intent.
DCMP is also open to prosecution and lawsuits under the Good Samaritan Laws because they are trained law enforcement officers.
In other word, DCMPD screwed up and has opened itself to all kinds of lawsuits and criminal charges.

The Montgomery County police pray for just such an event. These guys are so anxious to have a conflagration against the citizens that they have more fire power than an average Marine unit in Afghanistan. If those cops even heard a rumor of someone having an AR-15 in that house they would have made Waco look like a training exercise. The municipalities who have fostered and promoted SWAT teams are ticking time bombs for trigger happy cops who are all dressed up and nowhere to go.

I have a funny (it's funny now) story about Trigger-happy police. As freshmen in highschool, some of my buddies were goofing off one day (it was during the week). The highschool had finals which only took half the day, so we all got off that afternoon. They went to one of my friends' house, and, being only 14 or 15 at the time, dressed up in faux-Army camo and started running in and out of the house, pretending to shoot at each other with toy guns. Anyway, there was a grade school across the street from this house, and the kids were out on the playground at recess at the time. An idiotic neighbor who had watched Bowling for Columbine no doubt, called the police with news "they're gonna shoot up the school." (continued)
Within 5 minutes, the cops had the entire block surrounded w/ snipers 200 yds away. They blockaded the house and forced my 3 friends on the ground. Thankfully, their mother had just come back from the store, so she could help explain they were just goofing around. But think of what could have happened? One of my buds could have thought the Swat team who charged the house to be joking or to be one of his friends. Had a Swat member seen what at first glance appears to be a gun from someone in faux-camo coming around the corner of the garage, might they have reacted poorly? (AKA shoot) Who knows?
Anyway, I can vouch for your statement. Cops are ready for action, especially in sleepy, suburban areas (much like my town and Montgomery Cty are). Although trained, they are very, very raw and probably very nervous/excited.

The DC government operates as an extortion unit. There aren't enough tax paying citizens in the District for them to operate so they use law enforcement as a revenue collection authority. Teenage boy? What is he a wimp? I would have called every friend I know and they would have showed up armed and with every dog we know. We wouldn't be waiting for the "cops" to escort the protesters. I had a lot of weapons growing up given to me by my parents with the purpose that I learn to defend myself. There would have been plenty of protesters with chunks taken out of them and more on the way still to the ER if they had showed up on my front lawn after I hit twelve.
Must plaintifs in these law suits file in DC court, or can the venue shop like product liability and medical malpractise lawyers? If in DC, fat chance. No bluer judiciary east of California.
