The family of Greg Baer, Bank of America executive, is located in a jurisdiction protected by the Montgomery County Police Department (MCPD), which responded promptly to a disturbance call from his neighborhood last weekend.
According to Corporal Dan Friz, an MCPD spokesperson in Rockville, Maryland, the department received a disturbance call from one of Baer’s neighbors at 4:10 pm last Sunday. Four MCPD units arrived at Baer’s Greenville Rd. address at 4:15 pm. At least two Metropolitan Police Department units from the nearby District of Columbia were already at the scene when they arrived.
Why? Because police cars attached to the Washington MPD’s Civil Disturbance Unit had escorted the SEIU protesters’ buses to Baer’s home. Such cross-jurisdictional escort activity is not uncommon for both departments according to Friz and Metro Police Department spokesperson Officer Eric Frost. Still, the District police did not inform their colleagues of what was about to happen in one of their Maryland neighborhoods.
The Maryland officers reported there were approximately 500 protesters on and near the front lawn of Baer’s house. Montgomery County was not given a “heads-up” concerning the planned protest. Although a protest permit is technically required in Montgomery County, in practice no citation is issued if the protestors disperse when requested to do so by the owner of the private property they occupy.
The primary role of the Washington cops in this event was to protect the protesters. The D.C. officers had no authority to act to disperse the protesters even had the homeowner been present and asked them to vacate the private property. The event ended as a “dash one”– no arrests, no citations – according to Friz. The Montgomery County units left the scene at 5:29 pm.
According to Friz, “members of protest groups know how far to push the envelope” and wait for “the key words” – for example, the property owner’s request that they leave – in order to avoid arrests or citations. For example, protesters are required to keep on the move, since a standing protest violates a Montgomery County code. And, while photographs clearly suggest that many of the SEIU protesters were stationary, the District police don’t have any authority to enforce Montgomery County laws.
So, let’s sum this up: A caravan of SEIU buses receive a Metropolitan (D.C.) Police Department escort to a private home in Maryland where the protesters, from all appearances, violate Montgomery County law by engaging in a stationary protest. The Montgomery County police were not informed by their cross-jurisdictional colleagues of the impending, unusually large protest pending in their jurisdiction.
What’s up with that? Had the mob decided to torch the house, the D.C. police would not have been authorized to intervene. Not their jurisdiction. They’re just escorts. Meanwhile, a teenage boy is home alone, frightened by what’s happening outside his front door.

I like to make one point, under the Patriot Act, any deputized law enforcement officer in the U.S. is a police officer no matter what state or jurisdiction they are in, within the United States, as such, DCMP is liable for all actions and damages done, they are also subject to prosecution for violations for not enforcing state and local laws or properly notifying the local jurisdiction in Maryland of their intent.
DCMP is also open to prosecution and lawsuits under the Good Samaritan Laws because they are trained law enforcement officers.
In other word, DCMPD screwed up and has opened itself to all kinds of lawsuits and criminal charges.

The Montgomery County police pray for just such an event. These guys are so anxious to have a conflagration against the citizens that they have more fire power than an average Marine unit in Afghanistan. I have a funny (it's funny now) story about Trigger-happy police. As freshmen in highschool, some of my buddies were goofing off one day (it was during the week). The highschool had finals which only took half the day, so we all got off that afternoon. They went to one of my friends' house, and, being only 14 or 15 at the time, dressed up in faux-Army camo and started running in and out of the house, pretending to shoot at each other with toy guns. Anyway, there was a grade school across the street from this house, and the kids were out on the playground at recess at the time. An idiotic neighbor who had watched Bowling for Columbine no doubt, called the police with news "they're gonna shoot up the school." (continued)
Within 5 minutes, the cops had the entire block surrounded w/ snipers 200 yds away. They blockaded the house and forced my 3 friends on the ground. Thankfully, their mother had just come back from the store, so she could help explain they were just goofing around. But think of what could have happened? One of my buds could have thought the Swat team who charged the house to be joking or to be one of his friends. Had a Swat member seen what at first glance appears to be a gun from someone in faux-camo coming around the corner of the garage, might they have reacted poorly? (AKA shoot) Who knows?
Anyway, I can vouch for your statement. Cops are ready for action, especially in sleepy, suburban areas (much like my town and Montgomery Cty are). Although trained, they are very, very raw and probably very nervous/excited.

Teenage boy? What is he a wimp? I would have called every friend I know and they would have showed up armed and with every dog we know. We wouldn't be waiting for the "cops" to escort the protesters. I had a lot of weapons growing up given to me by my parents with the purpose that I learn to defend myself. There would have been plenty of protesters with chunks taken out of them and more on the way still to the ER if they had showed up on my front lawn after I hit twelve.

I don't about TARP money for DC piglets, they are already on the federal welfare support system. DC is a federal welfare entity, it has no sustainable source of revenue. In a civil uprising, you would prefer to deal with the DC cops, they will run the way the New Orleans cops did during Katrina. The Montgomery County cops would keep the operation going long enough for Sean Penn to make a guest appearance and bring a Hollywood cast to study for a movie set.
What if the crowd became violent no one would be there to curb the riot. A group of 500 people is very dangerous. I hope the banker and his family were not there. Hypothetically speaking they'll stick together unless things break down into ethinic disputes. I was cycling in Rock Creek when these busses overwhelmed the roads and the protestors swarmed all over the park and trail trampling just about everything and everyone in front of them. For your first question, SEIU protesters are basically a group of trained monkeys (I dealt with them on a daily basis, within my department) they don't do anything until they are told to by their handlers and their handlers know exactly how far they can go. If it did get violent, the local department would be called in, of course, and mutual aid would also be called in from neighboring departments but without knowing the make-up of the departments I can only speculate how many officers that can be brought in, I would say the best they could do would be to muster and deploy around 100 or so police officers in about an hour maybe another 100 disbursed over the next 3-5 hrs. and that is if they have some large departments in the area that can send their manpower over. That would leave the police at a 5:1 disadvantage for the first few hours but by that time, a mob of 500 people can tear the place down.and then some. Who gets to decide what is and what is not moral? And who gets to decide who gets to decide? To me that's the question.
If the authority is invested in the constitution, then its not in the persons holding office. If its not, then the authority is in the hands of people, and those people change. The current administration in Washington is proof enough of why that's illisconceived.
As a libertarian I believe that authority is best invested in the individual. And by individual I don't mean anything goes. I mean that authority is invested in the parents raising children, in the small business owners providing jobs and products and services. Invested in We The People to run our own lives and communities. Government only makes that more difficult.
Of course some people will make bad choices, that's life, and they will have to deal with it. If that means drugs and prostitution for some, I imagine the reality would look much different with it legal and out in the open.

I am a unionized officer also (Fraternal Order of Police – not SEIU affiliated). I am not a big union person and am only part of the union because the department is a union shop. I will say that the FOP is about a conservative as unions get but there are many things that even the FOP does that I do not agree with. In regards to this incident, I think that the vast majority of officers in most areas of the US would have a major problem with what happened. I know I think that the conduct was unethical. The problem is that the order probably came from the top down. The officers were probably ordered to do the escort and the officers have to decide if the order is worth possibly losing their job or getting disciplined for not following orders. I don't know if this is the case, but I know it is not uncommon for officers to be ordered to do things that may not illegal but are also not ethical. I personally would have taken the discipline and fought it but I can't speak for all officers.

Shouldn't the DC police be arrested for participating in the illegal protest. They were specifically there only to protect the protesters (which apparently they did not have jurisdiction to do). I am a DC Police Officer and a member of the FOP, Fraternal Order of Police. We are the only union which endorses Republicans nearly 100% of the time. Mccain, Bush 2000, 2004 among others. I am a member of the DC Police Department and would like to clarify some misconceptions here. The FOP, Fraternal Order of Police is the only union that consistantly endorses Republicans- McCain, Bush 2004,2000 and so on. The rank and file mostly are conservative. I worked with a black lesbian officer who is a staunch Republican. The problem is that the city government is controled by liberal socialists who make obama seem moderate. The chief is nothing but a puppet of the Obamabot Mayor Fenty who is buddies with the SEIU. So there you have it. The Officers are following orders from this clown who runs the city.
Baybe the cops would be less inclined to sanction this type of behavior in the future.

From the video, it appears that they were trespassing on the home owners property. They were standing on the man's front porch. I might be able to understand if they were standing in the street. But to cross on to private property with out consent of the owner is trespassing isn't it? Not to mention the property damage that most certainly occurred just considering the number of people. If 500 protesters were to storm onto the White House, which in deed does belong to the "people", everyone would have been arrested with whatever force was necessary. I think Mr. Baer needs to sue the SEIU and the DCMPD for trespassing and willfully and knowingly violating Montgomery County code and violating Mr. Baer's property rights. I agree with indy1826.
