This morning, the Supreme Court handed down its opinion in the case of Citizens United v. FEC. The upshot of the decision is that “the Government may not suppress political speech on the basis of the speaker’s corporate identity.” Federal law prohibited corporations from donating money “for speech defined as “electioneering speech” or for speech expressly advocating the election or defeat of a candidate.” The Court held that corporations cannot be prohibited from speaking on political matters. Predictably, President Obama has already decried the ruling as a blow to the little guy and a helping hand to evil corporations.

Lost in most of the coverage of the decision (and conveniently ignored by President Obama, former “senior lecturer” at the University of Chicago Law School), is that, as Justice Kennedy points out, the ban on electioneering speech never applied to one type of corporation. And what type of corporation would be exempt from laws and regulations that chill the speech of all its corporate brethren? Why, the media corporation, as Justice Kennedy points out on page 35 of the opinion:
Media corporations are now exempt from §441b’s ban on corporate expenditures. Yet media corporations accumulate wealth with the help of the corporate form, the largest media corporations have “immense aggregations of wealth,” and the views expressed by media corporations often “have little or no correlation to the public’s support” for those views.
The law drew a line between two types of corporations: media corporations, and everyone else. Intentionally or not, it tilted political power toward the media and away from every other type of corporation (many of which, as Justice Kennedy observed, have limited resources, unlike, say, CNN.) The mere fact that media organizations were able to speak at all in the 30 days leading up to an election gave them an advantage over other corporations. Even if a media corporation tries to be scrupulously fair in its coverage of an election, the inevitable choice to cover one story over another gives an advantage to one side. By removing the government’s muzzle from corporations, the Supreme Court has restored some balance to the playing field.
Surely the little guy has an interest in hearing election messages from corporations. The government gets its message out, and the media gets its message out. Why shouldn’t ordinary, private-sector corporations be able to speak as well? Unless he is a member of the Civil Service or a public-employees’ union, the little guy’s livelihood is usually dependent on a corporation — not the government or the media. Why shouldn’t he be able to hear that Candidate X’s support for cap and trade will destroy his employer?
One of the most cherished metaphors in First Amendment jurisprudence is that of “the marketplace of ideas.” If the little guy is too dumb to sort through the marketplace’s offerings from big government, big journalism, and big oil, how can you expect him to be smart enough to vote?

There is still one organization whose free speech rights have been muzzled now for nearly a half century – Churches. Progressives long ago passed legislation that is still in force that blocks churches from expressing their free speech rights. If they do, the IRS can label them as no longer charitable and therefore their congregants can no longer count contributions to them as tax deductible.

The unspoken problem with this analysis is that the reason that media corporations would be susceptible to influence in their political reporting is that the restrictions on ownership of media outlets formerly imposed by the FCC have been deeply eroded. Hence, you have media outlets with conflicting interests by virtue of the nature of the primary business of their owner corporations. If media outlets had true independence, they would righfully be exempt from such a limitation, because it would infringe upon their role as monitors of government policy. So, essentially, the conservative push toward the privatization of the purpose of every endeavor, including the media, makes this analysis a self-fullfilling observation.

That violates the 1st Amendment, again. "Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof;" that means "hands off" as far as government is concerned. This was clearly understood by the Christians who put our founding documents together. The Alliance Defense Fund is sponsoring the PULPIT INITIATIVE to test the tactics of groups that use the Internal Revenue Service to intimidate churches and pastors into silence. Churches and their pastors should be able to freely speak – from a Scriptural basis – on political matters without improper regulation by the government. And in 2009 they have done exactly that, even RECORDING their "offensive and illegal speech" sending it DIRECTLY TO THE IRS. Guess what? The IRS is doing nothing. Perhaps the 1954 amendment to IRS Code 501(c)3 (passed without debate or analysis) to restrict the speech of non-profit, tax-exempt entities, such as churches could not survive a legal challenge. The ADF is doing what it can to pick this fight and will defend any church in court. And, there have been plenty of liberal churches getting away with it all along (Jeremiah Wright), making selective enforcement by the IRS on conservative churches a real problem.
So, for the last 54 years, out of fear of losing their tax-exempt status, our nation's pastors and priests have largely remained silent UNNECESSARILY. Rather than risk confrontation, pastors have often self-censored their speech, ignoring blatant immorality in government. If my priest and vestry support a candidate I don't like with church money, it ruins the church experience, and that experience is supposed to be all about God.
I get to deduct my offering from my taxes. My money goes farther since the church isn't taxed. More people get helped through the food pantry and ERD, and the women's shelter and AA. It's a good situation.

It was when churches were taken over by the state that they were used as tools to keep the people in line. A good example is when the King of England decided to become head of the church there. It wasn't because he felt he was a better theologian, it was because he wanted power. So in a way you are right, only it was exactly what the founding fathers were trying to avoid in the "shall make no law respecting an establishment of religion" part of the constitution. As to the part about being fried for being a heretic, yeah it did happen. It still does figuratively, just become a scientist and have research that doesn't support AGW and watch how quickly the faithful froth at the mouth and scream "heretic".
You do realize that the "shareholders" you're talking about there are the average Joe who has a 401k and a retirement plan right? They're not all fat cats. I can guarantee you that come next election cycle that there are going to be commercials out there by GE and other companies that say things and support candidates that I don't like. However, they often did it anyway, because they own NBC and MSNBC and several others. They don't have to be campaign ads to work. Corporations answer to the ultimate power in the free market … the consumer. When left untarnished by government regulations that drag them down to the least common denominator, the corporations will always do what they can for their consumers.
It is government who is having a problem answering to anyone and sadly, that is one issue that does not seem to be restricted by party lines. Why is it that the same party government that gave GM and Chrysler ownership to the Unions in favor of the stockholders (People like you who have a 401K and a vested interest in seeing the corporation succeed) also gave us NAFTA and CAFTA and higher taxes all of which took more government jobs overseas leaving a major gap for us here at home in Corporate Taxers and job opportunities for we the people? To put an oil company on the same playing field doesn't seem rational enough to convince a divided public.

It wasn't religion that cause the dark ages, it was a combination of a lot of factors. If you recall, after the dark ages it was religions and monasteries that helped rebuild civilization into the resonance.

Why not just set the limit at $100 trillion and get over it. I don’t ever recall one of these bills being vetoed, so quit the charade of agonizing and debating over the debt limit and get back to work spending us into oblivion.
