Not since the Salem witchcraft trials has there been a worse disgrace in the annals of Massachusetts jurisprudence: the railroading of an innocent Malden family during the legally sanctioned insanity known as the Fells Acres child-abuse case. Probably the apogee of the mass hysteria that gripped the U.S. beginning about 1995, the Amirault case continues to resonate – in part thanks to Martha Coakley’s inexplicable disinterest in seeing that justice was done.

And this: Why did Martha Coakley not lift a finger to free an obviously innocent man? As Ann Coulter noted just after the primary last month, she’s “too immoral for Teddy Kennedy’s seat,” which is really saying something:
In Tuesday’s primary election, Massachusetts Democrats chose as their Senate nominee a woman who kept a clearly innocent man in prison in order to advance her political career.
During the day care/child molestation hysteria of the ’80s, Gerald Amirault, his mother, Violet, and sister, Cheryl, were accused of raping children at the family’s preschool in Malden, in what came to be known as the second-most notorious witch trial in Massachusetts history.
It’s one thing to put a person in prison for a crime he didn’t commit. It’s another to put an entire family in prison for a crime that didn’t take place…
Coakley, the Middlesex County district attorney who became Mass. attorney general in 2006, was not the original prosecutor in the case. No, that would be her predecessor in the Middlesex job, our old friend Scott Harshbarger, best known recently as the man who whitewashed the ACORN investigation.
What was her role, then? Dorothy Rabinowitz, the brilliant, indefatigable columnist for The Wall Street Journal who did more than anybody to bring this travesty to public attention with a series of devasting articles while the case was going on, picks up the story in her Jan. 14 Journal column. Be sure to read the whole thing:
In 2000, the Massachusetts Governor’s Board of Pardons and Paroles met to consider a commutation of Gerald’s sentence. After nine months of investigation, the board, reputed to be the toughest in the country, voted 5-0, with one abstention, to commute his sentence. Still more newsworthy was an added statement, signed by a majority of the board, which pointed to the lack of evidence against the Amiraults, and the “extraordinary if not bizarre allegations” on which they had been convicted.
Editorials in every major and minor paper in the state applauded the Board’s findings. District Attorney Coakley was not idle either, and quickly set about organizing the parents and children in the case, bringing them to meetings with Acting Gov. Jane Swift, to persuade her to reject the board’s ruling. Ms. Coakley also worked the press, setting up a special interview so that the now adult accusers could tell reporters, once more, of the tortures they had suffered at the hands of the Amiraults, and of their panic at the prospect of Gerald going free.
On Feb. 20, 2002, six months after the Board of Pardons issued its findings, the governor denied Gerald’s commutation.
Gerald Amirault spent nearly two years more in prison before being granted parole in 2004.
How could this happen? A perfect storm of anti-male feminists, child psychologists and “recovered memory” snake-oil salesmen resulted in the ruining of the lives of a perfectly innocent family. The cynical manipulation by the Middlesex County prosecutor’s office of the child witnesses against Gerald Amirault who are now young adults makes it depressingly clear that the office of prosecutor is intended by its occupants to serve their political ambitions and not the cause of justice (”Amirault victims come out of hiding to keep him jailed,” Aug. 3). Martha Coakley and her cohorts and precursors know full well that children who were 3, 4 and 5 years old at the time of the Fells Acres trials some 15 years ago – 15 years filled with constant reassertions by prosecutors and parents of the validity of the original claims – do not, cannot and will not ever be able to have untainted memories of their experiences. Hauling these innocent young people out for a press conference was disgraceful.
These children were victims of politically ambitious and woefully ignorant prosecutors who chose to disregard the coercive interrogations by the inexperienced graduate student assigned to dig the “truth” out of the children, to ignore bizarre claims that defied all rationality (e.g. sodomy with lobsters and knives) and to close their eyes to the utter lack of substantiating physical evidence.

The "witch hunt" was pervasive in Los Angeles (Manhattan Beach) in the '80 also. The McMartin Pre-School Child Molestation case lasted 6 years at a cost of 15 million, put hundreds thru hell, and rightfully, obtained NO convictions. A total clusterf***, that ruined the lives of all the good teachers there. We still pray for them.

I've just finished reading the break down of the trail and accusations against the Amirault case, I am truly stunned ..

Read the book by Dorothy Rabinowitz, THE CRUELEST TYRANNY, which thoroughly discusses the Amirault case. This should be required reading in all Massachusetts schools and law schools for that matter. This is why I no longer believe that the death penalty should be administered (terrorist excepting) because there are just too many corrupt and politicly ambitious prosecutors like Nifong, Harshbarger and right here in Mississippi, Ed Peters.
The McMartin and Amirault cases also made it so much more difficult to get convictions in cases of ACTUAL child molestation….that is the real shame of the sex abuse hysteria of the 80's. Child molestation and abuse happens far too often, but these witch hunts did a true disservice to the children who truly are the victims of sexual abuse (with corresponding physical and corroborating evidence).
The perpetrators of child abuse and molestation are most often family members….like the uncle who raped his infant niece with a curling iron (plenty of physical evidence in that case)….and was NOT speedily indicted by Coakley.
No, it was actually fomented by child psychologists who claimed that 'children never lie' and who used discredited methods of questioning children (which actually led these children to parrot whatever increasingly more bizarre charge the psychologist came up with).
Reality Check: Children do lie. They are also easily led by suggestive questioning. Child abuse is terrible, but you don't do the victims of actual child abuse any good by using children's testimony obtained via discredited methods of questioning. It actually become much harder to obtain a guilty conviction (even in cases of real, documented abuse) as a result of the psychobabble that tainted the McMartin and Amirault cases. Many juries started having doubts about any of the testimony being honest. What a shame for the victims of abuse that actually did occur…..

Ms Coakley is a thorough product of the politics of her state. She will do anything to claw her way to the position she believes she is entitled too. In her case, the first requirement is a personal evil. She is a psychopath, willing to murder those who get in her way. Not by blood, but by the character assassination of either the people of her state or the victims she purposely did not defend. How many children and their families has she destroyed in the name of her incredible ego. Why would she be any different in the US Senate? It's just a bigger arena with far more potential victims. Unfortunately, her state has for many years found her actions to be acceptable representation of their rights.

Well Coakley's arrogance and cluelessness notwithstanding, I'd say that these kinds of cases (child abuse) bring out the puritanical witch hunter in prosecutors. The thing is, if you are going to prosecute someone with such a charge, you have a need to be right because it is one of the worst things you can charge someone with.
This kind of prosecutorial intransigence is typical of child molestation cases for that reason. We have seen this the Little Rascals Daycare case here in NC, as well as the McMartin Preschool case out in CA. Even in the case of obvious and overwhelming innocence on the part of the accused, even when the children were claiming things (at the coaching of child psychologists) that were physically impossible, the prosecutor continued to press the case.
If the field of psychology weren't so PC, examining the mindset of prosecutors in this area and what makes them act like this might be good for at least a few Ph.ds.
Oh, and the fact that white males are often the target of these witch hunts. Putting a white guy in jail is the sort of thing that makes every liberal prosecutors day. It allows them to feel like some balance has been restored to the Universe after putting so many black guys in jail.
