A major provision of the “Bipartisan Campaign Reform Act of 2002″, aka McCain-Feingold, was largely dismissed by the Supreme Court on January 21, 2010. President Obama’s reaction was swift and almost comically over the top.
With its ruling today, the Supreme Court has given a green light to a new stampede of special interest money in our politics. It is a major victory for big oil, Wall Street banks, health insurance companies and the other powerful interests that marshal their power every day in Washington to drown out the voices of everyday Americans. This ruling gives the special interests and their lobbyists even more power in Washington–while undermining the influence of average Americans who make small contributions to support their preferred candidates. That’s why I am instructing my Administration to get to work immediately with Congress on this issue. We are going to talk with bipartisan Congressional leaders to develop a forceful response to this decision. The public interest requires nothing less.
Uh-oh! Whenever they use the term “bipartisan” you know they’re trying to sucker us. It’s become as transparent as their disingenuous names for bills like the so called “Stimulus” which was supposed to fund “shovel ready jobs” and instead went to non-existent zip codes. Our unemployment rate went up dramatically.

But why is Obama so upset about the decision? He’s upset by unions and special interests donating large sums of money to candidates? This is the president who took $60 million from SEIU members and was visited by its head, Andy Stern, more than any other person last year. Obama’s “outrage” deserves a closer look.
First, why was this law written? And why did George Bush sign it?
The so called the “Bipartisan Campaign Reform Act” (remember what I said about “bipartisan”?) was supposed to solve campaign corruption and put an end to “soft money” in elections. They characterized it as the influence of the “rich and powerful.” What it did was shut down free speech for certain groups. If you wanted to help or hurt a candidate, support or defeat a law, you had to be a rich individual or a political party like George Soros or the Democrats.
If you and a bunch of people formed a group and pooled your money to support or fight some politician, sorry. If you were a company or corporation trying to fight laws that would have bankrupted or hurt you, sorry. If you were a union, sorry. But it went much further than that.
In typical fashion. the authors of the bill and its supporters puffed themselves up to declare how they were putting an end to corruption in Washington politics. They were going to “clean up the town” which is like saying they’re going to tidy up the sewers. What followed in the bill’s wake is arguably one of the most corrupt periods in American politics: an age of rampant disregard for what the public thinks by feral politicians drunk on their own hubris.
When he was running for president, George Bush called the McCain-Feingold ban on soft money a suicidal move for Republicans. His conservative supporters hated the bill and never forgave McCain. Yet as president Bush signed it, merely complaining that the bill was “flawed,” but those parts he didn’t like would likely be shot down by the Supreme Court. By signing it Bush could look bipartisan at a time when he was attracting major criticism for his actions leading to the pending Iraq war.
The bill was challenged multiple times over the years that followed, and bits of it were chipped away in the courts, but the major provisions survived intact. Until in the last election, a group called Citizens United tried to air a documentary critical of Hillary Clinton inside the timeline prohibited by the law. They challenged the FEC. Thus we come to the Supreme Court’s decision.

Justice Anthony Scalia ruled that the law was unconstitutional on First Amendment grounds:
The Amendment is written in terms of “speech,” not speakers. Its text offers no foothold for excluding any category of speakers, from single individuals to partnerships of individuals, to unincorporated associations of individuals, to incorporated associations of individuals
Indeed, to exclude or impede corporate speech is to muzzle the principal agents of the modern free economy. We should celebrate rather than condemn the addition of this speech to the public debate.
In a 5 to 4 decision, the provisions about corporations and unions was overturned. Nothing whatsoever about foreign donations. The president was blatantly dissembling on that claim.
President Obama and other progressives want you to fear that “evil corporations” will now decide who gets elected. But let’s be real here. The New York Times and MSNBC are part of large corporations and they are quite blatant in their support of candidates, or in attacking others. The law was used in a discriminatory fashion because that’s how progressives see free speech. “You’re free to agree with us.”
Notice that it was the progressive justices on the Court who dissented on this opinion.
The administration had big plans for limiting free speech on talk radio, the internet, Fox News and any other conservative outlets they don’t like. This decision took the wind out of their sails. If the law had stayed they could have used it as a weapon against candidates in elections. Scalia noted that books, TV shows, movies could all be banned as a result. Notice which party likes to ban such things. Michael Moore’s Fahrenheit 911 could have been banned under the law, but it wasn’t. Despite the fact it was not only false on so many fronts, it was critical of a sitting president during wartime. But Bush let it go. But the FEC, which had Democrats in it at the time, banned the Citizens United Hillary documentary.
Free speech got a reprieve under this ruling. But those who want to block political dissent will not stop in trying to control who can speak and who can’t. They want to pick and choose who wins. The president promised he would “develop a forceful response to this decision.”
We have to make up our own forceful response to to stop any more attempts to steal our liberty by those who would kill it.

If Progressives hate it, if they scream it's against "freedom" or "fairness" and if they seem extraordinarily upset, you can bet it's a good thing for America and you should support it.
The progressives/democrats only agree with free speech when it agrees with them. They cannot win in the arena of ideas with free and open debate, so they resort to the only effective tactic they have left: Use the police power of government to crush those with dissenting opinions and ideas.
The liberals are using this as a bash against any Republican or conservative who support this rule as being supportive of Wall Street and big bank industry (the ones who got a bailout). In reality the whole free speech issue pertains to ALL of America. To draw a line in the sand saying this group can speak (through support or donations) but this group cannot is in violation of the Constitution. They want to draw a line in the sand, but what gives them the right to draw that line? Who gets in, and who is excluded? Nothing about the ruling changed the existing laws about foreign donations being illegal (though Obamao violated that rule in grand style).

We all should keep this in mind as we decide who to support for the 2012 GOP Presidential nomination. EVERY candidate should be required to answer the following question:
"If Congress sends you a Bill, and you believe the Bill is unconstitutional, will you sign the Bill or not? Please provide your reasoning for signing or not signing."
Anyone who answers "Yes" should be eliminated from consideration, as should anyone who refuses to give a straight answer to the question.

Funny how "Unions" were not mentioned when he referred to specials interests and "evil" businesses. The corporations have been controlling our elections through the MSM for quite some time. It was a sweet ride for Obama, no one questioned him, you could not say anything negative or you were lambasted for being racist. It was the perfect storm, GE running NBC and sitting themselves up for great profit from Cap and Tax. LIberal CBS and CNN out for themeselves too. And we have no idea how many foreign interests funneled campaign contributions through ACORN!
The only voice the people had was through Fox. But now, corporations will have a voice and can tell their side. This is a great benefit for those of us that love the free market system. It has been under constant attack from the left and the MSM. Now the corporations will be able to speak and at least defentd themselves. I welcome their voice to the frey. Let all speak. Good point. Soros, SEIU, the Saudis have always concerned me as possibilites for the shadows who own Obama. But they failed to examine his history well enough (wonder why?) and hired a boob and a dupe so inexperienced, so jaded, and so lustful for power and the topple of capitalism along with all his other flaws we are just learning about Obama. And now their plot is derailed. I too, have wondered who directs Obozo as it couldn't be his incompetent self. Just an FYI: The Mcain-Fingold act was implemented with the explicit intention of silencing the NRA (National Riffle Association) or like associations. The incumbents in office realized the NRA cost Gore the 2000 election. They weren't about to allow that to happen again. This is ALSO why the current administration is not happy. In the upcoming elections the NRA will again be in play. As the Obama administration IS the most anti 2nd amendment administration ever, they are NOT happy with the outcome.

This law is exactly why I would not vote for McCain last November, and I partially regret voting for Bush in 2004.
The constitution is the constitution, and its far more important than any individual political career. Our right to free speech is far more dear than any ass hat in DC trying to curry the favor of the left or the MSM.

So they can spend, speak, etc., but don't cast a single ballot. Only individuals get to cast their vote.

What they despise – I think – is those that succeed by working within the system, legally. The left believes that's an impossible rigged game, so the only way any one could succeed is to have cheated. There fore the wealth is ill gotten gain, and ripe for progressives to belly up to and dig in.
I paid my dues to the AFT (teacher's union here in Dallas) for years. They sent my dues money to Democrat candidates' campaign funds every year. It was in the name of the members of the union and the First Amendment (along with a loophole to protect unions from McCain Feingold.) Corporations are owned by stockholders. Why does the president object to corporations supporting candidates in the name of the shareholders? Because unions support Democrats. Corporations support Conservatives who are business friendly. The first amendment was upheld. It's funny is it not that the Supreme Court is the liberals best friend when the Justices find in favor of liberal issues, but are a bunch of buffoons when they find in favor of the constitution? Which is it Mr. President?
I know that it would never happen but I would have loved it if the Justices all stood as one and walked slowly out of the room when he went on that rant.
Do not forget that his campaign received cash from the Gaza strip, a fact he went "two faced" on in the SOTU speech.

Unfortunately, based on that rubric, both the honest and the nefarious candidate would answer "no," and move onto the next question. There is no easy alternative to an open and rigid vetting process; examining the past positions, votes, publications, etc., of the candidate, and a good dose of critical judgment based on that evidence is the only way to insure that we are getting the official we are electing.

Yes SIR you hit the nail on the head, way to cut through the political BS. The 2008 presidential campaign was a huge constitutional fraud. Neither canidate met the Art.2 Sec1 NATURAL BORN CITIZEN constitutional POTUS requirement. NBC is defined as BORN on USA soil of 2 CITIZEN PARENTS. McCAIN was born in PANAMA and OBAMA'S father was not a citizen. While both are citizens they do not meet the higher constitutional standard of NBC.
Some sort of backroom deal was reached called SENATE RESOLUTION 511, allowing McCain to run, if Obama's eligibility wasnt questioned. would have liked to be a fly on that wall.

We just knew (didn't we?) that if Obama wasn't in favor of the decision, then the decision was in the best interests of this country.
All McCain/Feingold did was place control of campaign information in the hands of the so-called "mainstream media" and prevented anyone from "legally" refuting what they had to say. THAT'S how we got Obama in the White House. It COULD have been also called "The Incumbant Protection Act" just as easily. Congress, the Washington press corps and the thousands of D.C.-based lobbying groups constitute one, big club which desires only to protect its members from criticism and to protect their jobs and attendant perks. They all go to the same "A-list" parties, trade "favors" and trade "information." Congress-critters are treated in D.C. as if they were rock stars. That's really hard to give up and requires strength of character–something that's in relatively short supply in government "service."
One of the reasons I had such a hard time voting for McCain (I bit my tongue and did it anyway) was his support for McCain/Feingold and its obvious disdain for the 1st Amendment. I thought, "If he's that dismissive of the 1st Amendment, how can anyone be certain he won't be equally dismissive of the other 26?" "Corporations" aren't the issue. Great article. Yes Obama hates this latest Scotus decision which actually followed the Constitution and allowed free speech. Obama despises our Constitution. He is frightened to death that Scotus might finally hear the court cases for his Constitutional eligibility for President. The court cases that are now in appeal were thrown out because they lacked standing, not merit. That means the cases have legal merit. This is a legal issue that is perfectly valid and one we MUST see and insist gets addressed. We are to blame also for damaging our Constitution; by being easily manipulated and ignorant. We lack the courage to face down a nation who would rather give up their Constitution than face the Alinski style ridicule thrown at us by traitors.
When one part of the Constitution is abused or dismantled, no other part is safe.
