The following is a document that James O’Keefe sent to me last night and has authorized me to publish. It is O’Keefe’s version of events in New Orleans. I believe this is the first time anywhere that he has publicly given his full statement of what occurred.
The document was drafted by lawyers based on O’Keefe’s statements, and was intended to be offered as the factual basis for his plea. O’Keefe confirmed for me that this document is an accurate account of what happened.
What Really Happened in New Orleans
Factual Basis
On January 25, 2010, Messrs. James O’Keefe, Stan Dai, Joe Basel, and Michael Flanagan (collectively “Defendants”) entered the Hale Boggs Federal Building located at 500 Poydras Street, New Orleans, Louisiana (“Hale Boggs Building”), with no intent to commit a felony, but rather an intent to engage in political speech with respect to pending national healthcare legislation (the “Healthcare Bill”). During the several days before their entry to the Hale Boggs building, Defendants discussed opportunities to engage in independent journalism and political advocacy. One of the ideas raised during those discussions was a method to test the truthfulness of Senator Landrieu’s statements as to the reason for the inability of Tea Party members and other Louisiana constituents to contact her staff on the telephone to discuss her vote on the Healthcare Bill. The Defendants were advised that this was a recent story in the news in New Orleans.
Prior to the Defendants’ arrival in New Orleans there had been picketing of the Senator’s office by Tea Party Members and others. The controversy about Senator Landrieu’s phones was described in a prior news article as follows:
“We were stunned to learn that so many phone calls to Senator Landrieu have been unanswered and met with continuous busy signals,” Perkins said. “We asked them to call their Senators. They could get through to Senator Vitter, but not Senator Landrieu.”
“Our lines have been jammed for weeks, and I apologize,” Landrieu said in interview after giving a speech on the Senate floor Tuesday.
As a result, the Defendants devised what was, in retrospect, a poorly thought out plan to test the veracity of Senator Landrieu’s statements. The plan settled upon was for two of the Defendants to dress as telephone repairmen and, wearing an audio and video camera hidden in one of the hard hats they wore as part of their disguise, enter Senator Landrieu’s office and interview her staff while a third Defendant recorded the interviews using a second audio and video camera.
The group devised a plan involving disguises because they believed that if they simply entered Senator Landrieu’s office and identified themselves as journalists they would not likely receive truthful answers. They thought it likely that Senator Landrieu’s staff would be more candid with a repairman than a reporter. Looking back, the Defendants now recognize clearly that this plan was imprudent, and produced unintended security concerns and consequences that none of the Defendants anticipated. The Defendants agree that they should have anticipated these consequences and regret that they decided to proceed in that fashion.
Upon entering the Hale Boggs Building, the Defendants presented their real drivers license identifications to security officials and were not questioned as to the purpose of their visit to the Hale Boggs Building or where in the Hale Boggs Building they were going. Before passing through security, the Defendants placed all of their equipment (including all recording and video devices) through the security x-ray machines, as requested by the Hale Boggs Building security employees.
After passing through the Hale Boggs Building security checkpoint, the Defendants proceeded to the 10th floor, where Senator Landrieu’s office is located. Senator Landrieu’s office was and is open to the public and the Defendants entered through its open door. They spoke with members of Senator Landrieu’s staff, then separately left the Senator’s office and exited the Hale Boggs Building.
A short time later, the Defendants were “detained” by Federal Marshals. They believed they would be released when the US Marshals realized that they were journalists and immediately explained to the commanding US Marshal that they were journalists investigating whether Senator Landrieu wasn’t answering her calls.
Despite truthfully explaining, in detail, to the FBI and Federal Marshals that their purpose was solely to ask questions (and record the questions and answers) of Senator Landrieu’s staff regarding recently published statements by constituents that calls to Senator Landrieu’s staff concerning her vote in favor of the pending Healthcare Bill were not being returned and about the Senator’s public statement that her office phones had been “jammed,” Defendants were charged in a criminal complaint with a felony:
by false and fraudulent pretense enter and attempt to enter real property belonging to the United States of America with the intent to commit a felony: to wit, willful and malicious[s] interference with a working and use of a telephone system operated and controlled by the United States; in violation of Title 18 United States Code Section(s) 1036(a)(1), 1362, and 2.
At approximately 8 pm, the Defendants were taken from the Federal Building to the St. Bernard Parish Jail. The Defendants remained in jail overnight and were then transported the next afternoon in red jumpsuits and hand and leg irons back to the Hale Boggs Building where they were “arraigned” before Magistrate Judge Louis Moore, Jr., who released them on personal bonds of $10,000.
O’Keefe clarified to me that he and his companions entered only the public reception area of Sen. Landrieu’s office.
O’Keefe’s attorney Michael Madigan is scheduled to appear on Fox News Sunday tomorrow morning to discuss the prosecution.

When a Liberal Press member does that EXACT same thing to a Republican Office Holder – they have it as the top story on the 6 o'clock news and feature on 60 (dragging) Minutes. And it's ALL aired for the WORLD to see.
But NOOOOOOOO!! You can't do the EXACT SAME THING to a Dem. EVER.
They destroyed the video evidence? How is that allowed, under the law?
I wonder what was on the destroyed tapes? I bet Landrieu had something to hide. The government's actions were way beyond unreasonable.
So they printed a retraction and all is well? Like I said the other day, it's time for Conservatives to stop whining about being mistreated and stand up for themselves. The New Yorker lied about O'Keefe and should be sued (even if he can't win). Bragging about getting them to print about a retraction is embarrassing. You might as well say you got the school bully to apologize to you in private after he kicked your ass in front of the whole class.

Perhaps since this crime was committed in Louisianna O'Keefe can head down to the shore and help clean oil off of some birds as part of his community service. O'Keefe's side of the story just happens to make the most sense. If his plan was to bug the phones, why would he bring along hidden cameras to record his crime?
O'Keefe's explanation confirms my suspicions about what really happened, but I don't think it will convince the screeching lefties in the mainstream media. Now if he blamed the whole thing on George Bush, he'd be a Hero.

This Judge ordered private property to be destroyed, he needs to be investigated for destroying the evidence that could have vindicated the defendants in a different Court, aside from his politically biased kangaroo Court!!! Bohemond, ACORN was "using" the poor in that they were registering them to vote and made a business out of raising money and getting federal aid for them. But their crimes (embezzlement, etc) are smaller than many of Halliburton's.
Can you honestly say ACORN was targeted by O'Keefe because they were violating the FLA? If so, there are many worse violators. Why only go after ACORN?
You and me both know it's because ACORN registered Democrats and O'Keefe is a paid political operative trying to give the GOP an advantage in elections. I could really get behind O'Keefe uncovering corruption, but he only goes after one side, breaks laws along the way and falsely portrayed himself as a concerned citizen until the Village Voice reported he had received thousands from rich donors and hid it from his fans.
O'Keefe's secrecy here is blatant – why is he hiding from us what he said to the staffers? The staffers told the press his crew asked for access to the phone system, which is why the media speculated they were possibly looking to tamper or wiretap the phones. Note O'Keefe's side of the story leaves out everything that was said to staffers:

That's it? Not confirming or denying they asked for access to the phone closet? Why not clarify this if he is asking for the media to retract reports?
I can see him saying they asked for access to the phone system but never intended to touch it, tamper with it, wiretap it. We just wanted to film it working properly to sarcastically show that they were fine. But he is leaving this all out.
By the way, who says Landrieu saying the phones were "jammed" meant they weren't working? Didn't she just mean they were busy with calls? Maybe those speculating O'Keefe wanted to bug her aren't that crazy – we'll only know if and when he clarifies what they told staffers and the whole story comes out. The prosecutors in this case should have questioned them separately to find out their plans and motives, but thanks to Miranda rights, the clammed up and got their stories synchronized and ended up avoiding jail sentences.
With the JUDGE ordering the DESTRUCTION of the evidence – I'm going to have to call your post a bunch of BULL @#$%. Why the HELL do you think they want to EVIDENCE destroyed – because it was on the "governments" side?????

ACORN is guilty of voter fraud (among other things), which SHOULD be punishable by death. Of course, being dead has never stopped folks from voting for progressives. You say that Halliburton is guilty of committing crimes, and you MIGHT BE correct, but what does that have to do with ACORN's crimes ?
There are two thing you are failing to realize. Number one, two wrongs don't make a right. If you break the law and get away with it, does that mean that I can break the law too and not be called on it ? Absolutely not. Number two, if Halliburton is as evil as you claim, their power derives from their close ties with BIG, OPPRESSIVE GOVERNMENT. 'Crony capitalism', or 'fascism light', has been our form of government for many years, and is a type of BIG, OPPRESSIVE GOVERNMENT. Our government is getting even bigger and more oppressive under Obama and the progressives in the congress.
What we need to do is move towards a more transparent and less powerful government that regulates businesses with a few meaningful rules that have real teeth. Laws regarding monopolies, conflict of interest (lobbyists), and anti-trust, are really all we need, but the government needs to apply the law fairly and equally in all cases.
I hope you've learned something and you are welcome to ask questions at any time. I'll try to help you understand what is really happening politically, so you won't have to receive further brainwashing sessions from the MSM, HuffPo, Media Matters, and especially, the Village Voice. If you ask something and I don't know the answer, there are plenty of folks here who can pick up the slack, and I'll direct you to them. After all, I'm not a 'know it all', and unlike those on the left, I won't bullshit you.
Maybe James can think about it for say 36 days or so, till he shows up?Really, what frosts my cake is that we have to disguise ourselves to go into a Senators office to get the real facts.
