In Lydia DePillis’s article “Bodacious? Xtremely!,” published February 21st in the The New Republic, Ms. DePillis falsely states that James O’Keefe had to return to prison after he left the CPAC conference this past weekend:
[Hannah] Giles was there to accept the first annual XPAC Award for Impact on behalf of her undercover partner, James O’Keefe, who made it to the conference but had to return to prison earlier that day.
O’Keefe was released from prison jail in January on a pretrial services “signature bond.” He may travel within the state of New Jersey and out of state with permission from his pretrial services officer. He did not “return to prison” after leaving CPAC, nor was he obliged to do so.
We kindly request the issuance of a formal correction.

Just when you think you've seen it all, and heard it all, the left comes out with something like this. Unbelievable!
Thank you for cleaning up after the drive-bys! It's fascinating to see how little real journalism is practiced by folks drawing salaries for the tripe they print. I could probably write for one of these rags – just lie, lie, lie, as long as it's about the conservatives! Just make it up, no sources, no follow-up…easy peasy!
I very seriously doubt that James was ever held in a "prison." A "prison" is a facility for long term confinement of people who have already been convicted of a felony. They are purposely misusing the word "prison" in order to make people believe that O'Keefe has already been convicted of a felony. Dual-fold purpose there — a felony is a much more serious offense than a misdemeanor, and having been in prison means you are a convict, rather than someone to whom the presumption of innocence attaches.
I would be careful about adopting their language. In all probability, if Mr. O'Keefe were held in any facility at all, it would be considered a "jail," which is were you are held for offenses that can be exceedingly minor. I know from professional (and personal) experience that many people who have been held in jails are ultimately never convicted of anything at all.
For example, I was once held in a jail for a couple of hours before my daddy came and made my bail. The extreme offense: failed to pay a speeding ticket in one state, so another state suspended my license, so I was finally caught on my way to church one morning (with my girlfriend and her daughter) in a third state DWLS. The charge was eventually dropped with no negative repercussions, as I hope will be the case for Mr. O'Keefe.
Retracto, I request a retraction. James O'Keefe was never in prison. He was in jail.
I heard he needed permission from his prison boss to leave his cell to take a shower.
it's seems to much to ask that "facts" are confirmed before the story is printed….but why let them get in the way of a slanted story by the MSM….wtg Retracto for holding their feet to the fire!

Throughout the criminal-justice biz (my own), a "jail" is for pretrial detention, and confinement of those convicted of misdemeanors; almost always a municipal facility. "Prison" is a state or federal facility where felony convictions are served.

Seeing how the retraction requests since this site started have been 100% regarding O'Keefe, I'm starting to think that "retracto the correction alpaca" IS O'Keefe. I mean really….aren't there any other retractions to be made? Why such a laser-like focus on this one guy??

Why is it that Retracto continues to call on corrections about James O'Keefe, but refuses to call for corrections from hundreds of outlets that reported — based on misleading statements from O'Keefe and Breitbart — that O'Keefe was dressed as a pimp when he entered the ACORN offices, which he almost certainly wasn't?
Please make these calls for corrections, Retracto, starting with the Breitbart Washington Times column where he specifically claims that O'Keefe entered the ACORN offices dressed as a pimp. Otherwise your own calls for corrections are just hypocritical and self-serving.
Hopefully that will shut him up for awhile………..

Why is it that soooooo many articles are being written that lie about James O'Keefe? All he did was engage in the same sort of investigative journalism that liberals LOVE to brag about when it brings down conservatives.
Why didn't the Lame Stream Media devote the same attention to Woodward and Bernstein that they are to James O'Keefe? Answer: Liberals protect Liberals, and attack Conservatives.
Retracto is under no obligation to do the job that the LSM is constantly doing, which is closely scrutinizing every word that every Conservative utters, looking for every opportunity to pounce. On the other hand, there is a distinct shortage of people holding the LameStreamMedia accountable, and Retracto is doing his part.

That was what I was taught at Syracuse University College of Law as well (our dimwitted Vice President's son was one of my classmates). In NY, prior to trial and conviction or acquittal you're held in a "Jail" (usually administered by the City or County) while those convicted of felonies are sent to State Correctional Facilities. The dictionary definition of "prison" isn't really relevant when discussing a particular case or individual. The nomenclature used by the various States and jurisdictions does differ a bit, but almost universally defendants who have not been tried and convicted are held in jails. In the Federal system, some defendants who are denied bail or cannot post the bail set might possibly be held in a Federal Prison pending trial, but that is fairly rare and certainly not the case with Mr. O'Keefe.
FOUL! I smell the foul stench of a false retraction! They now say:

From my understanding, O'Keefe is not "confined." Again, the term "confinement" has a specific legal meaning in criminal law. If he has a bracelet and is "confined" to his house, or if he is in jail, then he is "confined." Otherwise, he simply is not. They are trying their best to make it seem like he is in "jail" or "prison."
THIS WAS NOT A RETRACTION AT ALL. They simply changed their wording. Weasly, to say the least.
It should also be noted that I was MISQUOTED!!! What I said to this "reporter" was "What Ms Gilles did was honourable, though her ego MAY have got to her". Also I said "Because of this stunt she became a political hero" NOT "Because of this one little prank, she becomes a political hero.”. While these phrases are quite similar, they are different in meaning. Sneaky trick! I
And further, XPAC was a great time. Steven Crowder and the comedian that came after him were hilarious! I had fun.

When they can't win their case with logic and facts, they fabricate it to fit there thinking. Remember, for them the end justifies the means. And yes I agree they are nuttier than a fruit cake. Has anyone ever had a fruit cake? Their not only nutty but they don't taste very good either.
While they're at it, they should correct Hannah's age. It would only take a simple google search to learn that she is 20, not 21.
Retracto has asked that movie reviewer, Ebert, I believe is his name, to retract some "teabag" comments.

Words have meanings, but even more so when it implicates legal status. It appears as petulant reacton to being called on a glaring inaccuracy .
It also reflects the mindset.. when their enemies are "convicted" in their minds, niceties such as trials, etc are easliy forgotten.

Jails are used for people awaiting trial. As a public defender, I never once visited a client in a "prison," but spent many, many hours visiting clients in a "jail." Even people accused of the most heinous crimes are held in a "jail" when awaiting trial, not a "prison."
At least, that's what I was taught at Tulane Law School, and what I observed being a public defender representing some truly deranged offenders for several years.
Or most of Obama's "special advisors", like Van Jones who had his conversion to progressivism while in prison.
And how many others are guilty of things that should have landed them in prison, such as cocaine (drug) possession, tax evasion, and the list goes on and on.
Even those of ya'll who have never been arrested for anything must at least be thinking "there but for the grace of God go I." I mean, come on, you can land in jail for sooooo many things. If you've never been in jail it simply means you've never been caught.
As in "take a shower, Boss?" What we have here is a failure to communicate!
