Nobody has to read the 2,310 pages of the health care bill to know why it will ruin health care in America. You don’t have to go any further than page 49, which marks the end of Subtitle E, “Governance,” to understand what’s coming. Subtitle E creates the office of the “Health Choices Commissioner,” the person charged with putting into effect all of the wonderful regulatory mechanisms that H.R. 4872 demands. But, in the regulatory sense, the Commissioner is not a person. The Commissioner is rather an institution, one that will have powers and responsibilities unprecedented in American history.
Even if Obamacare immediately did all of the things that the president claims it will (which I don’t for a minute believe); even if lowered the deficit, reduced the cost of health care, improved the quality of that care and increased access to it, does anyone who has ever dealt with any of today’s bloated, creeping, undead regulatory agencies of government actually believe that such a happy situation would last? If there is one thing that those of us who deal with government bureaucracy know, it is this: government bureaucracy never gets better, never increases in efficiency and never costs less. Never.

In my business, the environmental industry, the EPA has a position analogous to Health Choices Commissioner: EPA Administrator. Practically everything that the EPA does, on the federal and state levels, flows down from the power granted to the EPA Administrator. A president can appoint a marvelous Administrator, or a terrible one (Obama’s choice, Lisa Jackson, falls into the latter category) but it really doesn’t matter. The choice of the figurehead sitting on top of the pyramid is merely the difference between the thousands of thousands of bureaucrats on the bottom – the people who actually interact with the regulated community – creating a pile of obstacles the size of Mt. Everest to obstruct industry, or a pile the size of Mt. McKinley. Ultimately, it doesn’t matter, because you can’t get over, around, under or through the obstructions.
Every time a low level bureaucrat fines some Ma and Pa business tens of thousands of dollars because the owners failed to file Form A921-C on time, no matter that the business didn’t actually pollute, the bureaucrat acts with the authority of the Administrator. Every time a state agency refuses to issue a permit that would allow a business to expand, because the permit engineer isn’t smart enough to understand the business’ expansion plan, the agency acts with the authority of the Administrator. Every time some fuzzy-cheeked, fresh-out-of-college EPA employee tosses some new requirements at a manufacturer that adds unseen costs onto the price of the product that is produced, he is able to do so because he wields the authority of the Administrator.

This is what Obamacare means to me: it’s the most massive regulatory structure ever created, and it will inevitably mean that the creeping, grasping hand of government will interfere with your lives in ways that no one, least of all the president and Congress, can even imagine. If you’ve dealt with the EPA, OSHA, IRS or any of the other myriad alphabet agencies that were created to “improve” America, you recognize that this is so. Barack Obama, Harry Reid, Nancy Pelosi and all the rest don’t get it, because they’ve never had to deal with what we have to deal with.
If some progressive were to read this, there is no doubt that he or she would dismiss my attack on regulatory agencies as sour grapes. I’ve heard it before. “Trzupek represents industry – of course he’s anti-EPA. It’s in his self interest to have that attitude.” Not so. My job, which Obama would probably define as a “green job” by the by, exists solely because industry needs people who can defend industrial concerns when the bloated bureaucracy comes a-calling, palms-out. Absent that bureaucracy, absent an enormously complicated regulatory structure, nobody would need my particular expertise. But, my expertise doesn’t do anything to make America better, stronger or more prosperous. It only serves to help blunt some portion of bureaucratic excess that should never have existed in the first place. The best thing that could happen, in terms of the future of the nation I love, would be for my job to become completely unnecessary.
It follows that this new, massive bureaucratic structure that Obamacare hopes to create will undoubtedly result in exactly the same kind of unproductive waste. Insurance providers and the medical community will hire experts to push back against bureaucratic excess, and the bureaucracy will fight them tooth and nail in return. Consumers will fund both sides of the argument. Eventually, someone in Congress will notice that the expensive problems and Washington will attempt to “reform” the process, but – given the limitations of government – those reforms will only further complicate the process, thus making health care even less effective, less responsive and more expensive than it was before. That is the inevitable, proven course of government interference with the free market.

Bureaucracy is never the answer. Reagan understood that. The American people know that. The president and his allies in Congress haven’t a clue. Yet, here we are: in the midst of the greatest attempted power-grab in the history of this Republic. One sixth of our economy is at stake and those who hope to control it expect us to believe that, if they are successful, we will be better off. Nobody in America enjoys dealing with insurance companies. We get that. But the bureaucratic nightmare that Barack Obama wants to force down America throat is a completely unpalatable alternative

What I don't get is why they're not fixing the broken part of the health care system, why break the portion that is working just fine (better than a government run system will be anyway). The Health Care System hasn't been ruined as for years as some will have you believe, the lawyers are the one's driving up costs will frivolous law suits and bloated claims against doctors and hospitals. Put a leash on them and costs will decline. Additionally reign in the FDA with their strict guidelines for drugs and those prescriptions will come in line to where they should be.

Wage and price controls (WTF were they thinking?) were instituted after WWII to combat inflation. In order to compete for the best applicants, companies started offering medical insurance policies as a means of getting around the wage controls.
Every piece of "reform" legislation contains an invisible clause known as "The law of UNINTENDED consequences".

The EPA, although maybe a decent idea in theory, has only led to increased costs of doing business and has, in my opinion (I have litigated dozens of insurance cases where the EPA is involed in the underlying site cleanups) only increased the time and costs involved in environmental cleanup.

The real kicker is it's the government's abuses that have created the high cost of healthcare. The Medicare Fee Schedule which was placed to "control the price" of healthcare has so undercut physicians ability to run a profitable business that they have had to increase their prices to everyone else. After staying pretty steady for the majority of the 1900s the cost of healthcare began doubling every 4 years from 1966 on, 1966 of course is when Medicare came into full effect. It's no coincedence.
The best "change" would be for the federal government to get out of the health care business. If you look at the facts and are realistic, you will come to the same conclusion. Government has no business or success in anything that should be handled by the market place.

Sure, just tell me when that market is gonna start working? As it stands it is a shooting gallery for insurers. They have limited state competition, can drop the very people that most need healthcare, and have raised rates faster than any other paycheck deduction the last 10 years. It's NOT a FREE market. They are NOT competitive. Most foreign systems provide equal healthcare at a fraction of the cost. I simply don't understand why the measuring stick for any other kind of business suddenly shouldn't apply to healthcare.
Also, healthcare is actually one of the only things i think that the Government SHOULD be involved in. Especially when it comes to providing for the people who need the help most. Then again, it's the right constantly trying to push into bedrooms and wombs…

Obviously you and I have had many healthcare discussions and addressed a lot of concerns with the proposals in it but this is one of the things that I must admit even I sometime forget to add to my list of negatives. It does not exist. I have traveled to over 50 countries and am well aware of what is available through government run health care. It does not compare with what privately controlled businesses offer- there or here.

SO TRUE! We tried for 5 years to build a new convenience store, on a site that had been a gas station 70 yrs. earlier. EPA steps in. After 5 years of aggravation, 20 wells dug on one-half acre lot, thousands of tests and a report that was 5" thick…they finally allowed us build. They are still involved yearly to test several wells that had to be left available for checking. (The old gas tanks has rusted out, and some gas leaked into the ground.) At least 10 different people were involved in the decision making process.
If it had been cancer, we would have died before they fininshed.

I get my medical care from TriCare. I can answer your question…you have to be very careful about your choices. The better ones I have seen have told me flat out that they cannot afford things as they are. Change cannot improve this. .

Well, despite your first hand experiences, I have to point to statistical data. People in America do not have the highest life expectancy despite paying a lot more for their care. So sorry, but yes, some foreign countries are doing the healthcare thing better than us.
I agree that there are things in this bill that are not any better (or perhaps worse) than what I would like them to be. In that respect it is not unlike almost any other piece of legislation either party has ever put forth. But I am willing to give it a shot. Let the plan fail spectacularly and then we can all be told how wrong we were. But then we'll work to fix those problems, and see where that gets us. It's a work in progress, always has been and always will be.
I'd love to see all insurance companies pay the same for services at any hospital. I'd love to see insurance companies compete nationally. I'd love to see people have more options to get the care they need. And the current system does none of those things.
We have seen federal tax dollars squandered to buy power. We have seen the lives of dissenters, such as Joe the Plumber, ripped to shreds. This will be Health Care for Democrats. It is time to vote them all out. Let the recalls begin.

if you check the 2009 yearly inflation the hospital related services inflated 7.8% and the health insurance deflated 3.0%. From December 2005 to December 2009 hospital related services inflated 33% and the health insurance inflated only 8% total for the same period.

We have great healthcare and doctors here. It's the insurance companies that are the problem. They couldn't adapt with the times and self regulate. They have denied millions of Americans access to health insurance. This drives the uninsured into emergency rooms when their kid gets a cough. The ER costs a lot more to run than a regular doctor's office and clogs ER for seriously ill patients. At least the bill will not allow the health insurance companies to deny millions the right to buy health insurance and force us into bankruptcy or to lose our house and good credit to pay for our health bills.
President Obama says he doesn't care about the process, just the results. I would contend that the process is the most important part. If he believes results are the important part in the legislative process, does he also believe that in election process? If he does, then we can expect election results like they have in Venezuela, Iran, N. Korea, etc

John, one problem with your statement is that you leave out that medicare (your government) denies claims more often than the insurance companies.
I guess one question I still have is why is a student loan takeover included in the health care bill? I ask rhetorically. If anyone believes this is truly about health care and is for the takeover then answer that question.

FACT: The US is #1 in the world in quality of delivered healthcare. That's according to, not Cato or Heritage, but the WHO. FACT: The US medical system produces the best results in the world across nearly all categories of serious conditions. FACT: government healthcare has diddly to do with rates of homicide, vehicle accidents, or poor lifestyle choices.

You mean like welfare? Government programs are forever. And in the meantime we will all be trillions of dollars poorer.
You want to provide insurance for those Americans who genuinely can't (rather than choose not to) buy it, approx. 7-9 million people? It could be done in ten pages for a fraction of the trillions this horror will cost. And without racial quotas imposed on medical schools, either.
